Applying the institution of actio in rem in British and American maritime law

This paper raises the question of the use of the Roman institution – actio in rem in modern maritime law in Anglo-Saxon countries – Great Britain and the United States. It is important to draw attention to the understanding and the method as to how actio in rem against the vessel is used in shipping relations of common law system countries. The discussed institution has in fact evolved and the way of using it diFers from the original Roman way, as it is now used in maritime claims, mainly in maritime privilege. An indication of the usage of actio in rem in common law countries is seen in the possibility of seizure of the arrest of a ship in the in rem mode in connection with the investigation issued in maritime claims.References
