Zapłodnienie post mortem w wybranych krajach common law

Niniejszy artykuł prezentuje prawne uregulowania kwestii związanych z zapłodnieniem post mortem w A ustralii, Kanadzie, Nowej Zelandii oraz Stanach Zjednoczonych. W tym celu dokonano szczegółowej analizy obowiązującego ustawodawstwa oraz wybrano najistotniejsze orzeczenia sądowe, które w krajach common law mają charakter prawotwórczy. Przedstawiono również szereg stanów faktycznych związanych z okolicznościami poczęcia dzieci po śmierci ich rodziców genetycznych oraz towarzyszące im opinie, niejednokrotnie formułowane przez sędziów. Ponadto artykuł został wzbogacony o liczne akty, rekomendacje i wskazówki niemające charakteru norm prawnych, jednakże stanowiące istotny głos w dyskusji nad analizowanym zagadnieniem. Z uwagi na fakt, iż niektóre regulacje dotyczące zapłodnienia post mortem mają charakter in statu nascendi, wskazano możliwe kierunki ich rozwoju.
