Troska o skuteczną ochronę porządku prawnego, przestrzeganie zasad sprawiedliwości i rozwój miłości należy do podstawowych praw Kościoła, a więc uprawnień i obowiązków wszystkich członków Kościoła – wiernych duchownych i wiernych świeckich. Stąd wszyscy wierni mają naturalne prawo do dochodzenia i obrony przysługujących im w Kościele uprawnień, na właściwym forum kościelnym według przepisów prawa, a więc prawo dostępu do sądu kościelnego. Jest to jedno z podstawowych uprawnień, którego realizację Kościół ma obowiązek umożliwić i zapewnić wszystkim wiernym. To dochodzenie może odbywać się drogą administracyjną lub sądową.
