Changes in the Act of Ownership of Premises

Abstract

The Act of 20 July 2017 of the National Real Property Resources introduced amendments to the Act of Ownership of Premises of 24 June 1994, consisting of the addition of three new editorial units in the existing Articles 2, 7, and 11. When setting up separate ownership of premises, the new regulation imposes an obligation to take into account administrative acts such as: a local land use plan or a decision on land development and land use, and a building permit or an effective application, and permission to use. The Act also provides for a legal action for a declaration of the invalidity of the establishment of separate ownership without a starost (head of district) certificate. The Amendment was necessary, but the editorial aspect of the new legislation raises a number of doubts.
