Digitisation of the investment and construction process (selected issues)

Abstract

The aim of this article is to present selected issues of the digitisation of the investment and construction process, its pillars and the role it plays in the improvement of planning and construction procedures. The digitisation of administration itself is not a new phenomenon; however, its encroachment into the domain of internal relations regulated by the planning and zoning law and the construction law can be considered innovative and progressive. Achieving the aim of the article, apart from the analysis of the digital elements contained in the laws regulating the two most important pillars of the investment and construction process, was possible due to the approximation of the concept of the investment and construction process and showing its susceptibility to the development of new technologies. The issues of digitisation of environmental law were left outside the scope of consideration, recognising this stage as a component of the investment process. The receptivity of this process to the growth of digital tools progresses in proportion to the development of e-government and is an integral part of the development of modern administrative law, thus fulfilling the paradigm of sustainable development. The background to the digitisation of the investment process is the digitisation of administration itself, which is taking place as part of the digital transformation taking place in Poland and the European Union. The conclusions are that digitisation in this area has many benefits through greater involvement of citizens in public life, a number of digital improvements, and increased transparency of public administration activities, influencing the realisation of the right to good administration. The weaknesses of digitisation, above all the risk of digital exclusion, can be reduced over time through the development of telecommunications systems. Digitisation of the investment process is also a considerable challenge for public administration bodies. It is necessary to support public administration bodies in the process of adapting to the challenges of the digital age in order to use the full potential offered by electronic services.
