Conciseness of the justification of the judgment of the Voivodeship Administrative Court

Abstract

The aim of the article is to present the issue of conciseness of the justification of the judgment of the provincial administrative court. The author's remarks focus on the meaning of the very notion of brevity of the statement of reasons for a judgment, the scope of application of this requirement, and the consequences of its violation. In the author's opinion, the requirement of brevity does not have an unambiguous content and can be understood in two ways: as an obligation to include in the content of the justification only such elements that rationalize the judgment issued, and as a prohibition to formulate legal arguments and assessments in an unnecessarily long-winded manner. In the author's opinion, the requirement of brevity does not refer to all the elements of the justification required by law, and its violation – as a rule – does not affect the content of the judgment ruling.
