New standards for the hearing of minors in family matters introduced by the Act of 28 July 2023 on amending the Act - Family and Guardianship Code and some other acts

As a result of the amendment to the Family and Guardianship Code, signed on 2 August 2023 as of 15 February 2024, new standards concerning the protection of minors became effective in Poland. One of them is the institution of the hearing of the child by the court in family matters, which is one of the key issues in the context of protecting the child's rights and guaranteeing the minor the opportunity to express his or her opinion. The amendment makes it possible for a child to be heard in court trials if his or her mental development, state of health and degree of maturity allow it and the court takes into account the child's opinion and reasonable wishes. In civil procedure, this procedural act is not a measure aimed at obtaining evidence in a case, but its purpose is to learn the child's opinion, which should be taken into account, especially in cases that concern the child's environment. The hearing of the minor is essential to ensure his/her fundamental rights and at the same time constitutes an element of his/her right to protection in legal proceedings directly affecting the minor. The article mainly analyses the procedure constituting the new standards for the hearing of the child in family cases, in view of the changes introduced.
