Conscientious objection regarding an oath in the judicature of the Constitutional Court of the Italian Republic

The article raises the issue of conscientious objection regarding an oath in the Italian legal system. Decisions of the Constitutional Court of the Italian Republic show this objection in the light of the norms of criminal and civil procedure codes containing terms and phrases relating to God and religious values, which were questioned and changed in the amended codes for the obligation to tell the truth. Conscientious objection regarding an oath occurs when the swearer's conscience contradicts the law and does not allow him/her to comply with the given legal norm unless the manifestation of disobedience has been legalized or legally justified and remains unpunished in both cases.
