Between the norm and rationality: selected dilemmas of a sworn translator translating for public authorities

The article discusses selected dilemmas that arise in legal translation practice when translating for public authorities. The dilemmas in question pertain to assignments not regulated at the statutory level, entries in a sworn translator’s register, and mistakes in the source text. In the opening remarks, the author discusses the concepts of legal norm (Chauvin et al. 2017), rational action (Weber 1922), and dilemma. He places a sworn translator between the norm and rationality, observing that he very often has to act rationally rather than strictly follow the law. The dilemmas discussed are illustrated with the examples taken from the author’s translations done between 2011 and 2018. First, the author focuses on the dilemma of refusing or accepting an assignment when the remuneration for the task is not covered by the Regulation of the Minister of Justice of 24 January 2005 on the Remuneration of Sworn Translators. One of the reasons to accept such an assignment may be the fact that a certain task must be done because the authority wants the translator to do it. Another example provided by the author shows that the translator needs to use the key word “translation” on an invoice to obtain remuneration for the assignment. Then, the author comments on entering in his sworn translator’s register the translation of the whole file as a single assignment instead of entering each document from the file as consecutive assignments. Finally, he refers to mistakes in source documents, including typographic and date errors. According to the author, the former should be corrected by the translator without any comments; with regard to the latter, the ordering authority should be consulted. Confronted with such dilemmas, a sworn translator very often has to act rationally even if this requires circumventing the law because meeting the needs of legal proceedings is more important.
