Irregularities related to conclusion of a public procurement contract and public finance discipline

Public procurement covers processes related to an expenditure of public funds. The public procurement procedure should culminate in a conclusion of an agreement between an ordering party and a contractor who guarantees proper performance of the public procurement. However, the ordering party does not have a free will in shaping the content of the contract, because in the case of public procurement the civil principle of a freedom of contract (regulated by Article 3531 of the Civil Code) is restricted by the Public Procurement Law. The aim of this study is to answer a question: what irregularities related to a conclusion of
a public procurement contract may constitute an act violating public finance discipline? In this article a non-reactive dogmatic-legal research method was used.
