On the Dynamic Development of the Prohibition of Torture by the European Court of Human Rights in the Second Half of the 20th Century

The prohibition of torture and ill-treatment contained in Article 3 of the European Convention on Human Rights, which was originally intended to serve only as a protective mechanism against the relapse of individual states into barbarism, now comprehensively protects the dignity and physical and psychological integrity of the individual, thereby setting clear limits to state action in many areas. This evolution derives from the dynamic case law of the European Court of Human Rights, which is examined in this article.
