Zur dynamischen Weiterentwicklung des Folterverbots durch den Europäischen Gerichtshof für Menschenrechte in der zweiten Hälfte des 20. Jahrhunderts

Das Verbot von Folter und Misshandlung in Artikel 3 der Europäischen Menschenrechtskonvention, das ursprünglich bloß als Schutzmechanismus gegen ein erneutes Abgleiten einzelner Staaten in die Barbarei gedacht war, schützt heute die Würde und physische sowie mentale Unversehrtheit des Einzelnen in einer umfassenden Weise und setzt damit dem staatlichen Handeln in vielen Bereichen klare Grenzen. Zurückzuführen ist dies auf die dynamische Judikatur des Europäischen Gerichtshofs für Menschenrechte, die in diesem Beitrag nachgezeichnet wird.
