Excluding citizens of other countries from social insurance as a permitted action of the Zakład Ubezpieczeń Społecznych

Abstract

The pandemic introduced the possibility of obtaining subsidies for employees whose payments were controlled by ZUS. Also, the agreement between Poland and Ukraine on social security of 18 May 2012 states that a person who worked and was subject to social insurance in Poland and Ukraine may obtain a pension from both Poland and Ukraine. Initiation of explanatory proceedings in these cases occurs when the insured person wants to use social insurance benefits, and most often it is a sickness benefit or a retirement benefit. The analysis of such cases was carried out based on our own research resulting from several years of professional practice in social insurance, which leads to the conclusion that the scale of abuse in the above-mentioned aspect is not significant, but it meets with social disapproval.
