Since a ditch belongs to the specific structure of the land improvement, which regulates hydrographic conditions in a relatively large area, and its influence considerably extends beyond the “neighbouring land” within the meaning of Article 29(3) of the Water Law Act, and if the changes made to one ditch affect the hydrographic conditions in a large area, then this matter is related to the specialist area of the land improvements, which by law falls within the duties of the head of poviat (starosta). What determines the character of such a water structure is not its current state, but the purpose and method of its original development.Downloads
