Cases of Fugitive Peasants in the Castle Court of Vilnius (in the Second Half of the Eighteenth Century)

The article presents the cases of fugitive peasants brought up to the castle court of Vilnius between 1765 and 1792. The study is based on 170 verdicts of this court; however, only 29 of these were verdicts passed after evidentiary proceedings. Although it was not possible to establish the exact number of peasants in dispute, it undoubtedly exceeded half a thousand people. The article attempts to demonstrate how the norms defining the phenomenon of peasant flight, as outlined in the Third Statute of Lithuania and the Sejm constitutions, complied with court practice. The proceedings in the castle court of Vilnius concerning cases of fugitive peasants are thoroughly analysed. Key issues, such as the procedural parties, means of evidence, and the legal basis for the judgment, are critically examined.
