The article presents the conditions that must be fulfilled so that the planned activity of a construction of the waterway connecting the Vistula Lagoon and the Gulf of Gdansk would comply with the European Union legislation on Natura 2000 protected areas. Due to the projected significant negative effects on the European ecological network, Poland will have to prove the absence of alternative solutions and imperative reasons of overriding public interest for its implementation. For this purpose, selected rulings of the European Court of Justice and the opinions of the European Commission, issued under the Habitats Directive.References
