Can support systems regarding renewable energy (Parliamentary paper No. 2604) be considered as state aid?

The presented article is the analysis of support schemes included in the newly enacted Law of renewable energy. It is an attempt to answer the question whether the mechanisms contained in the abovementioned Law and Energy Law, which is the system of certificates and auctions, can be considered as state aid under the EU law. In order to answer this question the analysis of each of the conditions of state aid along with their characteristics and the relevant case law has been carried out. Additionally, Polish renewable energy support schemes have been compared with the other EU solutions. Assuming that Polish mechanisms might be considered as state aid it has been also analysed if they could be classified as unlawful.References
