Liability is one of the basic instruments of environmental law. The criminal liability is used for the purpose of environmental protection in order to penalize a behavior, which negatively impacts the environment and thus is considered by the legislator and the public as especially hazardous. The usefulness of this regime for the protection of the environment was noted at the EU level and consequently the directive 2008/99 on the protection of the environment through criminal law was enacted. The aim of this article is to characterize the directive 2008/99 and its implementation into Polish law.Downloads
