Concept of legal liability for environmental damage under German law

Legal liability for environmental damage is diffuse and multifaceted in German law. There is no uniform definition of environmental damage, it has been defined in a number of legal acts and generally refers to the field that the legal act regulates. The Damage Act is an attempt to partially, but ineptly, unify the provisions governing liability for environmental damage and serves primarily to implement Directive 2004/35/EC. Civil liability is mainly based on the principle of fault and the scope of civil law protection does not cover the environment as such. Liability in administrative law is based on instruments of a repressive and controlling nature. In German law, there is no criminal liability for collective entities and no single act covering all offences.
