Zakaz tortur i złego traktowania zawarty w artykule 3 Europejskiej Konwencji Praw Człowieka, który pierwotnie miał służyć jedynie jako mechanizm ochronny przed ponownym popadnięciem poszczególnych państw w barbarzyństwo, chroni obecnie godność oraz integralność fizyczną i psychiczną jednostki w sposób kompleksowy, wyznaczając tym samym wyraźne granice działań państwa w wielu obszarach. Wywodzi się on z dynamicznego orzecznictwa Europejskiego Trybunału Praw Człowieka, które zostało prześledzone w niniejszym artykule.
