Nowadays, transplantation is no longer said to be medical experiment. It is acknowledged method of treatment. World human organization said that transplantation is the transfer (engraftment) of human cells, tissues or organs from a donor to a recipient with the aim of restoring function(s) in the body. We can distinguish <em>ex vivo </em>transplantation (with participation of living donor) and <em>ex mortuo </em>transplantation (with participation of deceased donor). The laws of different countries allow potential donors to permit (opt in system) or refuse (opt out system) donation. In Poland there is an opt out system which means that potential donor has to raise an objection in order to not to be donor after death. There is no questions if an adult person raise an objection, but there is number of doubts if we said about minor’s consent or objection to organ donation. Now, it is necessary to improve polish transplantation law in order to increase organ availability and increase deceased donations to their full potential.</p>}, journal={Studia Iuridica Toruniensia}, author={Konarska, Paulina}, year={2016}, month={Feb.}, pages={107–124} }
