During this time, employees cannot perform gainful employment within the framework of the employment relationship; they are then entitled to maternity benefit from sickness insurance. The article, referring to the judgment of the Supreme Court of 21 October 2020, draws attention to the problem of undertaking gainful employment within the employment relationship by an employee during maternity leave. It was emphasised that in such a situation the employee is entitled to remuneration for the work performed.
