A number of research problems focus on the question of the validity of the bid bond of the selected offer. It can be deduced from the civil law, that the status of being bound by the selected offer ceases with the selection made by the contracting authority. The offer loses its legal autonomy and becomes an element of the pre-contractual relationship. This means that the statutory obligation to return the bid bond, which occurs when the offer’s validity has expired, does not apply to the selected offer. The state of being bound by the offer and the validity of the tender bond, coexisting before the selection of the offer, are separated. It allows the bid bond to fulfill its key function, which is securing a claim for the conclusion of a public procurement contract.</p>}, journal={Studia Iuridica Toruniensia}, author={Lubiszewski, Maciej}, year={2021}, month={Nov.}, pages={177–192} }
